What is Workers' Compensation?
Workers' compensation laws are both federal and state laws. In general, these laws define what happens when an employee is injured at work. The New Mexico Workers Compensation Administration is located in Albuquerque. This administration oversees a complex system of laws that regulate many programs and services for:
- Workers
- Employers
- Insurance carriers
- Self-insured businesses
- Health care providers
- Related organizations
When you have an on-the-job accident, your employer has certain obligations to compensate you for your injuries. Because the laws are very complicated, it is best to have an experienced attorney work with you to be sure your employer does everything it should to help you recover.
New Mexico Workers' Compensation Law
Your employer in New Mexico is required to display a poster giving directions of what to do if you are injured at work. The poster must be displayed in a place where all employees can see it. A Notice of Accident Form should be attached to the poster. You should use the form to report your accident to your employer.
The poster tells you what your rights are as an employee and what obligations your employer has to you. It is important to know that:
- You should fill out the Notice of Accident Form
- When you give the employer your completed form, he or she must accept the form as official notice of your accident or injury; your employer is required to date and sign the form and return a copy to you
- Your employer or its insurance company must pay all reasonable and necessary medical costs of your injuries
- You may or may not have the right to choose your health care provider
- You have the right to get information and help from an information specialist called an ombudsman
