The exception is that a child younger than six years old has until his or her ninth birthday to file a lawsuit.
  • Contributory or Comparative Negligence — The Supreme Court of New Mexico passed a law in 1981 that says that if someone is partly responsible for their own medical injury, they will still be paid, but that the payment will be reduced by how much of the injury is their fault.
