About Workers' Compensation

Your employer is obligated under the law to keep your work and working environment safe. According to both state and federal laws, if you have been injured at work, your employer is obligated to compensate you for your injuries. A complex set of laws governs what is covered and how much your employer must pay.

Examples of Workplace Injuries

The following are only a few examples of the many types of injuries your Albuquerque employer must help pay for.

Your injuries can be physical, such as:

  • Loss of a limb (due to heavy machinery or construction work)
  • Repetitive stress injury (due to typing or computer use stress injuries; working with a punch press or any machine requiring repetition of a motion in a machine shop)
  • Harm to any part of your body (for example, harm to your eyes because proper eye gear is not provided)
  • Paralysis (loss of use of an arm or leg due to a crushing injury to the spine)
  • Poisoning or disease due to a toxic environment (for example, mesothelioma from asbestosis, or black lung disease from working in a mine)

Injuries can also be psychological due to a stressful workplace. Posttraumatic stress injuries are valid reasons for compensation.

If you have been injured on the job, look for a poster that by law should be within plain site of all workers. The poster defines your rights and the procedures you should follow if you are injured.

Notice of Accident Form

A Notice of Accident Form should be attached to the poster. You should complete the form, providing as much detail as you can, and give it to your employer who must date and sign it and return a copy to you. The poster also will tell you that you have the right to a representative or ombudsman to help you with your claim.
